Terms of Service

Effective date: July 21, 2026

These terms are an agreement between you and PremisePad ("we," "us," or "our") governing your use of the PremisePad platform at premisepad.com, including the tenant portal. By creating an account or using the service, you agree to these terms and to our Privacy Policy.

1. The service

PremisePad is property management software: tools for tracking properties, tenants, leases, rent, maintenance, documents, and communication, plus online rent payment. The service is currently offered as a beta — features may change, be added, or be removed as the product develops. We'll do our best to communicate meaningful changes in advance.

2. Your account

You must be at least 18 to use PremisePad. You're responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly if you suspect unauthorized access. Information you provide must be accurate — including the email address we use to reach you.

3. Your content and data

You retain ownership of the data you put into PremisePad — property records, tenant information, leases, documents, and photos. You grant us the limited rights needed to host, process, display, and transmit that data in order to provide the service (for example, sending a rent reminder email on your behalf, or showing lease details in your tenant's portal).

If you enter personal information about other people — such as tenants — you're responsible for having the right to do so and for its accuracy.

4. Payments

Rent payments are processed by Stripe under Stripe's own terms, including the Stripe Connected Account Agreement for landlords receiving payouts. PremisePad is a software platform, not a bank, money transmitter, or escrow service — funds move directly between tenants and landlords through Stripe.

Fees are disclosed before they apply. Landlords pay a platform fee equal to a percentage of rent collected through the Service, deducted from the transfer to their connected account; tenants who choose to pay online pay a convenience fee — a flat amount for bank transfer and a percentage for card — displayed, together with the total, before the payment is confirmed and itemized on the receipt. The current rates are published on the Pricing page and any change is published there before it takes effect. Rent collected outside the Service carries no fee. A landlord-specific rate, where one applies, is shown to that landlord before it takes effect. Disputes about rent owed, charges, or refunds are between landlord and tenant; we'll provide records to help, but we don't adjudicate them.

5. Not legal, tax, or financial advice

PremisePad may provide document templates, reports, and reminders as conveniences. They are not legal, tax, or financial advice, and using them doesn't guarantee compliance with any law. Landlord-tenant law varies by state and city — review important documents with a qualified professional in your jurisdiction.

6. Your responsibilities

You're responsible for complying with the laws that apply to your rental business, including landlord-tenant, fair-housing, security-deposit, late-fee, and notice requirements. You agree not to use PremisePad to violate any law, infringe anyone's rights, send spam, upload malicious code, attempt to access other organizations' data, or interfere with the operation of the service.

7. Termination

You can stop using PremisePad at any time and request deletion of your data. We may suspend or terminate accounts that violate these terms, create risk for us or other users, or are required to be closed by law — with notice where reasonably possible. Sections that by their nature should survive (like limitations of liability) survive termination.

8. Disclaimers

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that data will never be lost — keep copies of documents that matter to you.

9. Limitation of liability

To the fullest extent permitted by law, PremisePad will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amounts you paid us in the twelve months before the claim arose (or $100 if you haven't paid us anything).

10. Changes to these terms

We may update these terms as the service evolves. For material changes we'll update the effective date and notify account holders by email or in-app notice before the changes take effect. Continuing to use the service after that means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any disputes will be resolved in the state or federal courts located in Escambia County, Florida.
